Welcome to Arbie Style. Throughout these Terms, the words “we”, “us” and “our” refer to Arbie Style. Arbie Style operates this store and website, including the information, content, features, tools, products and services made available through it, to provide you, the customer, with a curated shopping experience (the “Services”). Arbie Style is powered by Shopify, which helps us make the Services available to you.
These terms and conditions, together with any policies referenced in them, are referred to as these “Terms of Service” or “Terms” and explain your rights and responsibilities when using the Services.

Product descriptions may be changed at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of products offered to any person, geographic area, or jurisdiction on a case-by-case basis.
Section 3: Orders
When you submit an order, you are making an offer to purchase. Arbie Style may accept or reject your order for any reason at its discretion. Your order is not considered accepted until Arbie Style confirms acceptance. We must receive and process your payment before your order can be accepted. Please check your order carefully before submitting it, as Arbie Style may not be able to accommodate cancellation requests once an order has been accepted. If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided when the order was placed.
Your purchases are subject to returns or exchanges only in accordance with our Return and Refund Policy.
You represent and warrant that your purchases are for personal or household use only and are not intended for commercial resale or export.
Section 4: Prices and billing
Prices, discounts, and promotions may change without prior notice. The price charged for a product or service will be the price shown at the time your order is placed and will appear in your order confirmation email. Unless clearly stated otherwise, listed prices do not include taxes, shipping, handling, customs fees, or import charges.
Prices displayed in our online store may differ from prices available in physical stores or in online or other stores operated by third parties. From time to time, we may offer promotions through the Services that affect pricing and are governed by separate terms and conditions. If there is a conflict between promotional terms and these Terms, the promotional terms will apply.
You agree to provide accurate, complete, and current purchase, payment, and account information for all purchases made through our store. You also agree to promptly update your account and other details, including your email address, credit card numbers, and expiration dates, so we can complete your transactions and contact you when needed.
You represent and warrant that (i) the credit card information you provide is true, accurate, and complete, (ii) you are authorized to use the credit card for the purchase, (iii) charges you incur will be honored by your credit card company, and (iv) you will pay all charges incurred by you at the posted prices, including shipping and handling charges and any applicable taxes.
Section 5: Shipping and delivery
We are not responsible for shipping or delivery delays. All delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events beyond our control. Once products are handed over to the carrier, title and risk of loss pass to you.
Section 6: Intellectual property
The Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, videos, audio, and the design, selection, and arrangement of such materials, are owned by Arbie Style, its affiliates, or licensors and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.
These Terms allow you to use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Arbie Style’s names, logos, product names, service names, designs, and slogans are trademarks of Arbie Style or its affiliates or licensors. You may not use these trademarks without prior written permission from Arbie Style. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing on the Services belong to their respective owners.
Section 7: Optional tools
As part of the Services, you may be given access to customer tools provided by third parties. We do not monitor, control, or have input over these tools.
You acknowledge and agree that access to these tools is provided “as is” and “as available,” without warranties, representations, or conditions of any kind and without endorsement. We will not be liable for any issue arising from or related to your use of optional third-party tools.

The Services may include materials and links to websites provided or operated by third parties, including embedded third-party features. We are not responsible for reviewing or evaluating the content or accuracy of third-party materials or websites you choose to access. If you leave the Services to access third-party materials or websites, you do so at your own risk.
We are not liable for any harm or damages related to your access to third-party websites or your purchase or use of any products, services, resources, or content from third-party websites. Any complaints, claims, concerns, or questions regarding third-party products or services should be directed to the third party.
Section 9: Relationship with Shopify
Arbie Style is powered by Shopify, which allows us to provide the Services to you. However, all sales and purchases made through our Store are made directly with Arbie Style. By using the Services, you acknowledge and agree that Shopify is not responsible for any part of any sale between you and Arbie Style, including any injury, damage, or loss resulting from products or services purchased. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Arbie Style.

All personal information we collect through the Services is governed by our Privacy Policy, and certain personal information may also be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

You also agree that your Feedback will not contain libelous, unlawful, abusive, or obscene material, or any computer virus or other malware that could affect the operation of the Services or any related website. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Arbie Style, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, INCLUDING NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF USING THE SERVICES OR ANY CONTENT OR PRODUCT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

You agree to indemnify, defend, and hold harmless Arbie Style, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, payable to any third party and arising out of or related to (1) your breach of these Terms of Service or the documents incorporated by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that any failure to notify you promptly will not release you from your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including the choice of counsel, but we will not settle any claim requiring non-monetary obligations from you without your consent, which must not be unreasonably withheld. You agree to cooperate in the defense of indemnified claims, including by providing relevant documents.
Section 18: Severability
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision will still be enforceable to the fullest extent allowed by applicable law, and the unenforceable portion will be deemed severed from these Terms of Service. This determination will not affect the validity or enforceability of the remaining provisions.
Section 19: Waiver; entire agreement
Our failure to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of that right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in relation to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, replacing any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us, including any prior versions of the Terms of Service.
Any ambiguities in the interpretation of these Terms of Service will not be interpreted against the drafting party.

You may not delegate, transfer, or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any attempt to do so will be null and void. You and Arbie Style consent to venue and personal jurisdiction in such courts.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes on our website. Your continued use of or access to the Services after changes are posted means you accept those changes.
